Slot Machine Player's Jackpot Denied

A man who claims he won a $737,000 jackpot on a slot machine is planning to sue the casino he played in, after the casino declined to pay him, saying that it was not really a legitimate win but a big mistake.

Sornpaserd Unkeowannulack, 31, from Clovis, California, played the nickel slots at the Table Mountain Casino on Friday, when the slot machine announced he won the jackpot. However, before he could celebrate his win, officials at the Indian gaming club claimed the machine was broken and that he wasn't eligible for the prize.

Unkeowannulack used his cell phone to take a picture of the machine, and his friend called attorney Scott Kinney.

Table Mountain Casino Chief Executive Officer John Mayewski said there was no winning combination of symbols on the screen that signified a jackpot. He also said that the maximum prize for this particular Deep Pockets machine was in fact $2,500. The maximum progressive prize for the entire group of machines where Unkeowannulack was playing was $10,000 or a motorcycle.

Mayewski said the casino is investigating what caused the malfunction. Representatives from the slot machine manufacturer and also software vendor were at the casino Saturday, but Mayewski said it could take several days before an official report is ready.

Dan Casas, Table Mountain's tribal attorney said that it's like going to an ATM where the maximum withdrawal is $300 and having the machine spit out $30,000 - Is that money really yours?

If you only have $300 in your account, and the ATM spits out $30,000, it's unethical to claim the money because you know it's not yours. Things are a bit different in a casino because you are there to play for a chance to increase whatever amount you have in your pocket, and not to withdraw from your account. And if a slot machine proclaims that you're a jackpot winner,whether or not the machine is jammed, you are entitled to the prize. The argument here shouldn't be how much money you're supposed to win, but how much you actually won.

And if the machine is really malfunctioning, it's not your fault. They should taken it out before somebody cries "I won! I won!"
